1. Acceptance of Terms:

• By accessing or using this website, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access or use the Website or purchase Prints.
   

2. Orders & Payment:

• All orders are subject to availability and acceptance by Winston Tan Photography.

• We reserve the right to refuse an order for any reason.

• Prices are listed in New Zealand Dollars (NZD) and are subject to change without notice.

• We offer secure payment options, including credit cards, debit cards, PayPal, Afterpay, and bank transfer. Payment is due at the time of purchase.
   

3. Shipping & Delivery:

• Shipping is currently available within New Zealand only.

• Shipping costs are calculated at checkout based on total spend.

• We offer standard shipping only.

• Estimated delivery times are provided, but cannot be guaranteed.

• International shipping is currently unavailable.
   

4. Returns & Refunds:

• Since all Prints are made to order, we do not accept returns for unwanted items.

• We accept returns for Prints damaged in transit when notified within two days of receipt. See our Returns Policy for details.

 

5. Personal Use Image License Agreement

• Usage:

  • The image may be used for one-time personal printing only, offering the freedom to select preferred size and paper type. This option is perfect for personal use or international customers who wish to print locally.

• Restrictions:

  • The image may not be used for any commercial purposes.

  • The image may not be shared, resold, or distributed as a stand-alone file to any third party.

6. Commercial Use Image License Agreement

• Winston Tan Photography hereby grants you a non-exclusive, non-transferable license to use, modify (except as expressly prohibited herein), and reproduce our images worldwide, in perpetuity, as expressly permitted under the selected license and subject to the terms and limitations outlined herein:

• Standard Image License

  • Usage:

    • The image may be used for digital and online purposes, including websites, blogs, e-publications (e-books, e-magazines, etc.), e-cards, social media, email marketing, web/mobile advertising, mobile apps, software, and online media platforms (YouTube, etc.) if the total expected number of viewers is less than 500,000.

    • The image may be used in printed materials, including marketing materials and product packaging, if the total number of print reproductions is less than 500,000.

  • Restrictions:

    • The image may not be used to create merchandise, templates, or other products for resale or distribution where the image is the primary value of the product (e.g., t-shirts, mugs, posters). 

    • The image may not be used for offline media, such as TV or film. 

    • The image may not be reprinted as wall art for resale.

    • The image may not be shared, resold, or distributed as a stand-alone file to any third party.

    • The image may not be used for illegal purposes (e.g., pornography, defamatory content, etc.).

• Enhanced Image License

  • Usage:

    • The image may be used with all the rights granted under the Standard License.

    • The image may be reproduced beyond the 500,000 viewer/copy restriction.

    • The image may be used to create merchandise, templates, or other products for resale or distribution where the image is the primary value of the product (e.g., t-shirts, mugs, posters).

    • The image may be used in offline media, such as TV or film.

  • Restrictions:

    • The image may not be reprinted as wall art for resale.

    • The image may not be shared, resold, or distributed as a stand-alone file to any third party.

    • The image may not be used for illegal purposes (e.g., pornography, defamatory content, etc.).

7. Intellectual Property:

• All content on this website, including images, text, and logos, is the intellectual property of Winston Tan Photography or its licensors.

• You may not reproduce, modify, distribute, or commercially exploit any content without our written permission.
   

8. Limitation of Liability:

• We are not liable for any damages arising from your use of this website or the Prints.
   

9. Governing Law:

• These Terms shall be governed by and construed in accordance with the laws of New Zealand.
